TERMS OF SERVICE
BRICE I.T. SOLUTIONS LC
1. ACKNOWLEDGMENT AND ACCEPTANCE OF THE TERMS OF SERVICE
This BRICE I.T. SOLUTIONS LC Terms of Service ("TOS") is provided to you the client ("Client") in connection with the BRICE I.T. SOLUTIONS LC Technical Support Service ("Service") purchased by the Client.
2. SERVICE DESCRIPTIONS
System Diagnostic & Repairs - Check unit for defective hardware. Check for software errors and virus/malware. Resolve Issues. Hardware issues discovered will incur additional costs for replacement parts.
Virus Removal - Removal of virus, spyware and other malware. System updated and protected to prevent future infections. System optimized to increase performance.
Computer Setup - Computer first time setup and configured. Installation of anti-virus, e-mail setup and additional client provided software.
Wireless/Wired Network Setup - Setup and configure wireless router & additional networking components. Secure network and connect all devices. Optimize for signal strength (wireless) and speed.
Hardware Upgrade - Installation of all client provided or purchased internal hardware upgrades. Optimize and testing of new hardware.
Network Troubleshoot & Repair - Perform network diagnostics to determine issue and resolve issues. Optimize for performance and security.
Software Installation - Installation and configuration of purchased software.
Equipment Procurement - Component selection, assistance, delivered, setup, and configured.
Electronics & Software Troubleshoot & Repair - Diagnose and solve technical issues.
Network Drops - We do not perform network drops for safety reasons. If new network drops are required we can recommend someone or you can hire your own contractor.
Cloud Computing and Related - Recommendation, setup, configuration of business cloud based services.
Data Recovery Service -We will attempt to recover lost or deleted data with no guarantees of success.
Data Backup and Disaster Recovery - Develop a solution to handle data backups and disaster scenarios and execute it's implementation.
3. PAYMENT OF CHARGES/FEES
BRICE I.T. SOLUTIONS LC may change the fees or add additional charges at any time by giving Client notice prior to proceeding. All service fees are non refundable unless otherwise stated in writing prior to the service or at the sole discretion of BRICE I.T. SOLUTIONS LC.
4. MODIFYING TOS AND SERVICE
BRICEPC I.T. SOLUTIONS LC may change the terms and conditions of the Service at any time and the Client will be notified. BRICEPC I.T. SOLUTIONS LC reserves the right to modify or discontinue the Service without notice to Customer. BRICEPC I.T. SOLUTIONS LC is not liable to the Client or any third party should BRICEPC I.T. SOLUTIONS LC modify or terminate the Service. The Client agrees to these terms upon signing this contract and is bound to the TOS and all modifications. The client has the right to discontinue use of the Service upon receiving notice of changes to the TOS provided that all fees owed to BRICE I.T. SOLUTIONS are remitted in full.
5. CLIENT DATA AND CLIENT RESPONSIBILITIES IN RELATION TO DATA
Because there are so many circumstances beyond our control such as malware infections, lightning strikes or faulty equipment etc. BRICE I.T. SOLUTIONS will not accept responsibility for loss of data in any form or manner. Therefore the Client agrees that prior to BRICE I.T. SOLUTIONS LC servicing any Client equipment it is the Client's responsibility to back up the data, software, information or other files stored on any of the Client's disk drives and peripherals and/or on any other electronic storage device; and remove all disks such as CD/DVD, portable drives, or any other type of media from Client's product. The Client agrees that even if Client asks for or receives a back-up or data related services from BRICE I.T. SOLUTIONS LC, BRICE I.T. SOLUTIONS LC is not liable under any circumstances for any losses, changes or corruption of any data, or types of data/information.
6. LIMITATIONS TO SERVICE
BRICE I.T. SOLUTIONS LC reserves the right to refuse to perform purchased Services and refund the Client's payment partially or in full based on unmet technical needs, system requirements, any safety concerns, or if the Client is requesting service that is outside the scope of work or deemed unreasonable by BRICE I.T. SOLUTIONS LC and these aforementioned deterrents will be determined at BRICE I.T. SOLUTIONS LC's sole discretion.
Client agrees to indemnify, defend, and hold harmless BRICE I.T. SOLUTIONS LC (and any partners, subcontractors, employees or affiliates) from/against any all losses, costs, obligations, liabilities, damages, actions, suits, causes of action, claims, demands, liens, encumbrances, security interests, settlements, judgments, and expenses, (including cost of defense, settlement, and attorneys' fees) of any nature, including damage and/or destruction to property, injury, wrongful death to any person or person asserted against, incurred, imposed upon or suffered by BRICE I.T. SOLUTIONS LC arising from:
I. Client's breach of this Agreement;
II. Client's actual or alleged infringement of any patent, copyright, trademark, trade secret or other property or contract right of any other entity;
III. Client's failure to comply with applicable laws and regulations
IV. Client's failure to pay charges and fees owed to BRICE I.T. SOLUTIONS LC or third parties;
V. Omissions and/or acts of the Clients (including third parties, employees and affiliates)
8. DISCLAIMER OF WARRANTIES
Client agrees that use of our service is at the clients own risk and the service is provided "as is" with no warranties unless otherwise stated in writing. BRICE I.T. SOLUTIONS can not guarantee that a service will meet all the clients needs and expectations or requirements, or that the service will be uninterrupted, bug free, error free, easy to use, secure, constant in pricing, available, reliable or compatible.
9. LIMITATION OF LIABILITY
BRICE I.T. SOLUTIONS LC is not liable for damages arising from hardware, software or other product supplied to Client by BRICE I.T. SOLUTIONS LC. BRICE I.T. SOLUTIONS LC's maximum liability to Client under this Agreement shall be limited to the charges/fees paid by Client to BRICE I.T. SOLUTIONS LC as long as the service was performed less than thirty days from the date of the claim or action against BRICE I.T. SOLUTIONS LC. It is Client's responsibility to back up the data, programs, apps or software on Client's machines, hard disk drive, portable media or any types of storage devices. BRICE I.T. SOLUTIONS LC is not responsible for any losses, modifications, or corruptions of any apps, programs, software, data, files or any other types of data.
